Terms of Service

1. Agreement to terms

By creating an account or using Fretfolio ("Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms form a binding legal agreement between you and Fretfolio ("we", "us", or "our").

2. Eligibility

You must be at least 13 years old to use Fretfolio. By using the Service, you represent that you are at least 13 years of age. If you are between 13 and 18, you represent that you have your parent or guardian's permission to use the Service.

3. Your account

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You agree to:

  • Provide accurate and complete information when creating your account
  • Keep your password secure and not share it with others
  • Notify us immediately of any unauthorized use of your account
  • Not create accounts for others without their explicit permission

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions and billing

Fretfolio offers paid subscription tiers. By subscribing, you agree to the following:

  • Trial period: New accounts include a free trial period. After the trial, continued access to paid features requires an active subscription.
  • Billing: Subscriptions are billed monthly to the payment method on file. All fees are charged in US dollars and are non-refundable except as required by law or at our discretion.
  • Cancellation: You may cancel your subscription at any time from Settings → Billing. Cancellation takes effect at the end of the current billing period. Your data is preserved after cancellation and accessible upon reactivation.
  • Failed payments: If a payment fails, we will attempt to notify you via email. Accounts with unresolved failed payments enter a 30-day grace period before collection data is permanently deleted.
  • Price changes: We reserve the right to change subscription prices. We will provide at least 30 days' notice via email before any price increase takes effect.

5. Your content

You retain ownership of all content you upload to Fretfolio, including photos, gear records, and notes ("Your Content"). By uploading content, you grant us a limited, non-exclusive licence to store, display, and process Your Content solely to provide the Service to you.

You represent that you have all rights necessary to upload Your Content and that it does not infringe any third-party intellectual property rights. We will not share, sell, or use Your Content for any purpose other than operating the Service.

6. Acceptable use

Fretfolio is a platform for sharing musical instrument and gear collections. You agree not to use the Service to upload, share, or transmit any content or data that:

  • Is sexually explicit, obscene, or adult in nature
  • Is illegal under applicable law, including CSAM (zero tolerance — reported immediately to NCMEC)
  • Infringes on any third party's intellectual property, trademark, or copyright
  • Constitutes spam, phishing, or deceptive content
  • Harasses, threatens, or demeans any individual or group
  • Contains malware, viruses, or harmful code
  • Attempts to gain unauthorized access to the Service or other users' accounts

Violations will result in immediate account termination without refund. To report a violation, email abuse@fretfolio.app.

7. Public share pages

When you generate a share link for a gear item, that item becomes publicly accessible via that URL without authentication. You are solely responsible for the content of pages you choose to make public. You can revoke any share link at any time from your item's settings page. Revocation takes effect immediately.

8. Service availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform scheduled or emergency maintenance that temporarily affects availability. We are not liable for any losses arising from service interruptions.

9. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free, secure, or continuously available.

10. Limitation of liability

To the fullest extent permitted by applicable law, Fretfolio and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of goodwill, arising out of or in connection with your use of the Service. Our total cumulative liability to you for any claims arising from or related to the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim or (b) $50 USD.

11. Indemnification

You agree to indemnify and hold harmless Fretfolio and its operators from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from your use of the Service, Your Content, or your violation of these Terms.

12. Governing law

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved exclusively in courts of competent jurisdiction in the State of Texas.

13. Changes to these terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page and, for material changes, send a notice to the email address on your account at least 30 days before the changes take effect. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
